This Privacy Policy explains what information we collect when you use our website, place an online order, make a reservation, sign up for emails or text messages, apply for a job, or get in touch with us. We’ve tried to write it in plain English. If anything here isn’t clear, call us on (209) 521-8667 and we’ll explain it.
This is the short version of what we collect and why. The rest of this policy has the detail.
| What we collect | Why we collect it | How long we keep it |
| Name, email address, phone number | To send you marketing you’ve opted into, respond to enquiries, manage your reservation, run your loyalty account | Marketing lists: until you unsubscribe. Enquiries: up to 24 months. |
| Event enquiry details — date, party size, notes | To respond to your enquiry and plan your event | Up to 24 months |
| Order and payment information | To take and fulfil your order | Held by Toast under their own policy, not stored by us |
| Website activity — pages visited, time on site, referral source, device and browser type, approximate location (city or region) | To understand how the site is used and improve it | Per the retention settings of each analytics provider |
| Job application details, including any resume you upload | To consider you for a role | Up to 12 months |
Do we sell your information? No. We never take money for your personal information, and we never sell or share the mobile numbers collected for text message marketing.
Do we share it for advertising? Not at present. We are not currently using advertising or retargeting technology on this website. If that changes, we’ll update this policy before it goes live. Section 6 has the detail, and you can opt out at any time using the Your Privacy Choices link in our footer.
Your full rights are in Section 7.
This is collected through cookies and similar technology. See Section 5.
When you order, book a table, buy a gift card or use your loyalty account through Toast, Toast collects and stores that information under its own privacy policy. When you order catering through ezCater, the same applies. We receive order and reservation information as part of running the business.
We don’t ask for and don’t want sensitive personal information as defined under California law — things like precise geolocation, racial or ethnic origin, religious beliefs, health information, or the contents of your private messages. We don’t use any information for the kind of profiling that produces legal or similarly significant effects.
If you opted in to text messages from us:
We keep a record of your consent — the date and time, the source, your IP address and the exact wording you agreed to. We’re required to be able to demonstrate consent, and we keep those records for as long as you’re subscribed and for a period afterwards.
Full terms are on our SMS Terms page.
Our website uses cookies and similar technology. When you first visit, you’ll see a banner asking you to accept or decline.
If you accept: analytics tools collect data about your visit, as described below.
If you decline: those tools are disabled and don’t run. Everything you came to the site to do still works exactly the same.
You can change your mind at any time using the Your Privacy Choices link in our footer.
If your browser or a browser extension sends a Global Privacy Control signal, we treat that as a valid request to opt out of the sale and sharing of your personal information, and we honour it automatically. You don’t need to do anything else.
Google Analytics 4 — tells us how many people visit, which pages they look at and how they found us. policies.google.com/privacy
Microsoft Clarity — produces heatmaps and records anonymised sessions showing how people move through and interact with pages, so we can find and fix problems. Clarity masks form field contents by default and does not capture what you type into forms. It only runs if you accept cookies. privacy.microsoft.com
Klaviyo — our email and text message marketing platform. klaviyo.com/legal/privacy
Toast — online ordering, table reservations, gift cards and our loyalty program. toasttab.com/privacy
ezCater — catering orders. ezcater.com/privacy_policy
We don’t sell your personal information for money, and we never have.
Some advertising and analytics technology involves disclosing information in a way that California law defines as a “sale” or “sharing” for cross-context behavioural advertising. We are not currently using advertising or retargeting technology on this website. If that changes, we’ll update this policy and the date at the top before it goes live.
If we do use it in future, the categories involved would be identifiers, commercial information, internet and network activity information, non-precise geolocation data, and inferences drawn from these. The businesses involved would be third-party advertisers and analytics providers.
We never sell or share the mobile numbers collected for text message marketing.
We have no actual knowledge that we sell or share the personal information of anyone under 16.
To opt out at any time, use the Your Privacy Choices link in our footer, turn on Global Privacy Control in your browser, decline cookies when you first visit, or contact us using the details in Section 11.
Under the California Consumer Privacy Act, you have the right to:
Know what personal information we’ve collected about you, where it came from, why we collected it, and who we’ve disclosed it to.
Access a copy of the personal information we hold about you.
Delete the personal information we’ve collected from you, subject to some legal exceptions.
Correct any personal information we hold about you that’s inaccurate.
Opt out of the sale and sharing of your personal information.
Limit the use of sensitive personal information. We don’t collect or use sensitive personal information in any way that triggers this right, but the right exists and we’ll honour any request.
Not be discriminated against for exercising any of these rights. Your service, your prices and your loyalty points are unaffected.
Contact us using the details in Section 11. We’ll respond within 45 days. If your request is complex we may need up to a further 45 days, and we’ll tell you if that happens and why.
To protect your information, we’ll ask you to confirm two or three pieces of information that we can match against our records before we act on a request.
You can appoint someone to make a request on your behalf. We’ll ask them for written proof that you’ve authorised them, and we’ll still need to verify your identity directly with you before we process it.
If we turn down a request and you think we’ve got it wrong, email us and say you’d like to appeal. We’ll look at it again and come back to you with our reasoning.
Separately from the CCPA, California residents can ask for a list of any third parties we disclosed personal information to for their own direct marketing purposes during the previous calendar year, under California Civil Code Section 1798.83. Contact us and ask for the “California Shine the Light Notice.”
If you live in another US state with a comprehensive privacy law, you have broadly similar rights — to access, correct, delete and obtain a copy of your personal data, to opt out of targeted advertising and sales, and to appeal a decision. Contact us using the details in Section 11 and we’ll handle your request under the law that applies to you.
We may send you emails about your order, your reservation or your account. Those are part of providing the service you asked for.
If you’ve opted into marketing emails and change your mind, click the unsubscribe link at the bottom of any of them, or just contact us. Unsubscribing from marketing doesn’t affect emails about your orders or bookings, and it doesn’t affect the service you get from us.
Where information is used for more than one purpose, we keep it until the longest of those periods runs out.
We take commercially reasonable and appropriate steps to protect personal information from loss, misuse and unauthorised access. That said, no internet transmission or storage system is ever completely secure, and we can’t guarantee absolute security. If you have an account with us, you’re responsible for keeping your password to yourself.
Our website isn’t intended for children. We don’t knowingly collect personal information from anyone under 13, and we have no actual knowledge that we sell or share the personal information of anyone under 16. You must be 21 or over to opt into our text messages. If you believe a child has submitted information through our website, contact us and we’ll delete it promptly.
Our website links to other sites and services — Toast for ordering and reservations, ezCater for catering, and our social media pages. Those are run by other companies with their own privacy policies and their own way of doing things. Have a read of theirs before you use them.
If you like, follow or share our content on social media, the platform may receive information about you and about your visit to our site. Check your settings on those platforms if that matters to you.
We may update this policy from time to time. When we do, we’ll change the date at the top. If the changes are significant, we’ll make that clear.
